Mont Co Building & Codes UPDATE EFFECTIVE JUNE 1, 2015
The Tennessee Department of Environment and Conservation (TDEC) requires each builder in a subdivision or development where more than one acre is disturbed to submit a Notice of Intent and appropriate fees to TDEC. The associated tracking number issued by TDEC must be submitted to Building and Codes on the Erosion Prevention & Sediment Control (EPSC) Plan for Small Lots form. This form is available at the Building and Codes office and is part of the application required to obtain a Montgomery County Building Permit. If a TDEC tracking number has not been obtained prior to the time that the building permit has been applied for, the date that the Notice of Intent was submitted to TDEC will be entered on the Small Lot form in the "TDEC Permit Tracking No." space and a Building permit will be issued pending the issuance of the TDEC Tracking number.
In some cases, the initial developer may be able to provide a copy of the original Notice of Intent that can be filled out and submitted with appropriate fees to TDEC by the builder. If a Notice of Termination has been issued to a developer by TDEC, each builder must then submit a Notice of Intent, site map, Storm water Pollution Prevention Plan (SWPPP) and permit fees to TDEC in order to receive a Notice of Coverage. The Notice of Coverage tracking number must be submitted to Building and Codes. If a TDEC tracking number is not submitted to Building and Codes within 30 days, a stop work order can be issued for that building site until a tracking number is submitted. Building lots not associated with a subdivision or development and disturbing less than one acre must still submit an Erosion Prevention & Sediment Control (EPSC) Plan for Small Lots form. In this case the "TDEC Permit Tracking No." space will be marked "N/A". Adequate erosion controls are required on these sites.
